A Ghanaian lawyer cum special prosecutor Mr. Kissi Agyebeng has released all charges in connection to the tax evasion case that was presented against lawyer Mahama Ayariga.
Mr. Kissi Agyebeng released these charges on Monday, October 11 and he continued with relevant reasons why the case should be ceased.
He stated that “We wish to inform the court of the republic’s intention to enter Nolle prosequi in respect of all cases against the accused person,” and he also gave relevant reasons why the case should be discontinued
First, “upon further scrutiny, the Republic deem it unable to prove it case base on available evidence on the standard of proof on criminal bases – that is to prove beyond a reasonable doubt.”
Second, “this case appears certain to suffer the same fate as the earlier one with case number FT0122019 the Republic vs Hawa Nichema and six others which were dismissed on May 7, 2021, on the application of submission of no case to answer.”

The National Democratic Congress(NDC) MPs were put on trials over two issues which are bleaching procurement processes in the purchase of some ambulances for his constituency and the second is tax evasion in the importation of some “luxurious” vehicles
Those who were standing on trials are Despite and six others, the court discharged the former youth and sports Minister on Friday, May 7.
Justice Afia Serwaa Serwaa Asare-Botwe who is in charge of Accra High Court cleared and discharged all seven after the defense lawyers endorsed submission of no case filed.
The court cleared and discharged Mahama Ayariga but the case is still hanging and they are going to resume trials on Monday.
Mahama Ayariga was accused of abusing his office after clearing three Toyota V8 vehicles without paying tax and also sued for illegal transfer of foreign exchange from Ghana to Dubai without a license to undertake such transaction.
A car rental dealer Mr. Kendrick Marfo who is about 50 years was also sued for purchasing these vehicles from Mahama Ayariga.
